AFFIDAVIT OF YOUR NAME

I, YOUR NAME AND ADDRESS (unemployed) aged eighteen years and upwards MAKE OATH and say as follows:
1. I am the named Defendant in the above entitled proceedings. I make this Affidavit from facts within my own knowledge save where otherwise appears and where so appears I believe the same to be true and accurate.

2. I say and believe this Defendant has a bone fides defence against this Plaintiffs claim, I say the plaintiff at all material times has failed to furnish this defendant with the following in order to extend the right to a fair trial guaranteed under the constitution of this state which this defendant relies on,
(a) Quantification of alleged loss claimed by the Plaintiff before this honourable court
(b) Confirmation the said facility was not party to any financial derivatives which benefited the plaintiff, example, default swap, interest swap, transference of all legal and equitable rights.
(c) Confirmation of arrears claimed, ECB lending rate applied in December 2009 under bailout agreement, @ .075% to .025% at this day, No financial loss was incurred by the plaintiff other than aforementioned percentage applied. The current arrears sought would require over 1600% applied by the Plaintiff to warrant such arrears.
(d) Confirmation the alleged loan was redeemed reduced or satisfied by the securitization of the facility

3. I further say the failure of the state to provide council to this defendant places this defendant in an unequal unfair position, which this defendant considers to be unjust and a direct violation of this defendants constitutional rights under article 40 of the Irish Constitution..

4. This Defendant respectfully seeks from this honourable court; his?/her? rights under the constitution of this state to be up held, and seeks an adjournment of these proceedings to facilitate this defendants’ guaranteed rights are upheld..
